In September earlier this year, all four members of Decapitated were arrested under suspicion of kidnapping and rape after a concert in Spokane, Washington. They have since been formally charged with the rape of a woman, but have pled not guilty and now have been released from jail with a trial date set for Jan. 16 of next year.

The Spokesman-Review provided the update and have been covering the situation heavily. The report states that guitarist Waclaw "Vogg" Kieltyka was released on Monday (Dec. 13), while the rest of the band, drummer Michal Lysejko, vocalist Rafal Piotrowski and bassist Hubert Wiecek were released on recognizance on Nov. 22 and did not have to post the $100,000 bond. Judge Julie McKay ordered the four members to remain in Washington until the trial begins and were forced to surrender their passports.

In order to prevent the band from seeking refuge in their home country of Poland while they await their court date, Decapitated also signed waivers of extradition, meaning they would be extradited to Spokane if they did return to Poland. They're currently staying with attorneys and family in Washington and are forbidden to have any contact with one another without an attorney present.

The woman who alleges she was gang raped on Decapitated's tour bus is said to have “significant bruising to her upper arms consistent with being restrained” and “small abrasions to her knuckles that were scabbed over.” Meanwhile, court documents show Thy Art Is Murder singer Andy Marsh took note of the woman earlier in the night (the band was on tour with Decapitated) where she was in the mosh pit. “She was smashing her hands, arms and body against the metal barricade between the audience and the stage,” said Marsh.
